These Terms of Service ("Terms") govern your access to and use of the DefendHer Academy website at defendheracademy.com (the "Site") and the self-defense and firearm-safety instruction and related services we provide (the "Services"). Please read them carefully. By using the Site or enrolling in any class, you agree to these Terms.

1.Acceptance of these Terms

By accessing the Site, booking a class, or participating in any Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or our Services.

2.Who we are & what we offer

DefendHer Academy ("DefendHer," "we," "us," or "our") is a women-only self-defense and firearm-safety training provider based in Lakewood, New Jersey, operated by [DefendHer Academy legal entity name]. We offer instruction in jujitsu, kickboxing, and USCCA-based firearm safety, in private and group settings. Our Services are educational and instructional in nature.

3.Eligibility & women-only classes

Our classes are offered to women. You must be at least 18 years old to book and participate on your own behalf. Minors may participate only with the prior written consent and, where required, supervision of a parent or legal guardian, and subject to any additional requirements we set. By booking, you represent that you meet these requirements. We may request valid identification.

4.Assumption of risk & release of liability

Important — please read. Physical self-defense training (including jujitsu and kickboxing) and firearm handling involve inherent and significant risks, including the risk of bodily injury, and in rare cases serious injury or death. By participating, you voluntarily assume all such risks, whether or not foreseeable.

To the fullest extent permitted by law, you release, waive, and agree not to sue DefendHer, its owners, instructors, employees, and agents for any injury, loss, or damage arising out of your participation, except to the extent caused by our gross negligence or willful misconduct. You will be required to sign a separate written assumption-of-risk and liability waiver before participating; that signed waiver is in addition to these Terms. [confirm your waiver process]

5.Firearm training: safety & legal compliance

Our firearm instruction is educational and is not legal advice. You are solely responsible for knowing and complying with all applicable federal, New Jersey state, and local laws regarding the purchase, possession, transport, storage, and use of firearms and ammunition. You must meet all legal requirements to handle a firearm in order to participate in any firearm Service.

You agree to follow all safety rules and instructor directions at all times. We may remove you from a session, without refund, for unsafe conduct. [state whether firearms, ammunition, and range facilities are provided by DefendHer or supplied by the student] DefendHer does not sell or transfer firearms. [adjust if inaccurate]

6.Booking, payment, cancellations & refunds

Fees, deposits, and payment methods are as described at the time of booking. [describe your payment terms]

Cancellation and refund policy: [e.g. cancel or reschedule at least 24 hours in advance for a full credit; no-shows are non-refundable]. We may reschedule or cancel a session (for example, due to instructor availability or weather) and will offer a make-up session or refund in that case.

7.Participant conduct & right to refuse service

You agree to behave respectfully toward instructors and other participants and to follow all studio, range, and safety rules. We reserve the right to refuse service to, or remove, any participant whose conduct we consider unsafe, disruptive, or inappropriate, without refund.

8.No medical, legal, or professional advice

Our Services and Site content are for general educational purposes only and are not medical, legal, or other professional advice. Consult your physician before beginning any physical-training program. Nothing we provide should be relied upon as legal advice regarding self-defense or firearm laws.

9.Intellectual property

The Site and its content — including text, graphics, logos, the DefendHer name and rose-and-shield mark, and course materials — are owned by or licensed to DefendHer and are protected by intellectual-property laws. You may not copy, reproduce, or distribute them without our prior written permission.

10.Third-party links & services

The Site may link to or rely on third-party services (for example, messaging, mapping, or scheduling tools). We are not responsible for the content, policies, or practices of those third parties.

11.Disclaimer of warranties

The Site and Services are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted or error-free, or that training will achieve any particular result.

12.Limitation of liability

To the fullest extent permitted by law, DefendHer and its owners, instructors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site or Services. Our total liability for any claim will not exceed the amount you paid us for the specific Service giving rise to the claim. [confirm any cap with your attorney] Nothing in these Terms limits liability that cannot be limited under New Jersey law.

13.Indemnification

You agree to indemnify and hold harmless DefendHer and its owners, instructors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms or of any law.

14.Governing law & dispute resolution

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in [Ocean County, New Jersey / your venue], and you consent to their jurisdiction. [If you want mandatory arbitration or a class-action waiver, have your attorney add it here.]

15.Changes to these Terms

We may update these Terms from time to time. Changes are effective when posted on this page, and the "Last updated" date above will reflect the latest version. Your continued use of the Site or Services after changes are posted means you accept them.
